AIM National Salary Survey Terms and Conditions

NSS User Agreement
The AIM National Salary Survey (“NSS”) is published and owned by the Australian Institute of Management NSW & ACT Limited (ABN 20 000 049 669) ("AIM"). Your one-off purchase or annual subscription to NSS and access to its published materials through the website is conditional upon your acceptance and compliance with the terms, conditions, notices and disclaimers contained in this document (known as the "User Agreement").

Your acceptance of these terms and conditions and continued use of the NSS website constitutes an affirmative acknowledgment and agreement by you that you are prepared to willingly abide and be bound by these conditions set out below.

Refunds policy and payment information
Please choose carefully.  We do not normally give refunds if you simply change your mind or make a wrong decision.  You can choose between a refund, exchange or credit where goods are faulty, or are different to the product purchased. Details of the contents of the Survey (including positions covered in the Survey and the type of analysis provided) can be accessed from our Website. All amounts are in Australian dollars (AUD$). For online payments, the Merchant ID is owned by the Australian Institute of Management NSW & ACT Training Centre Ltd ACN 002 526 007.  The Australian Institute of Management NSW & ACT Ltd ACN 000 049 669 is the sole member of the Australian Institute of Management NSW & ACT Training Centre Ltd ACN 002 526 007.

Annual subscribers or one-off survey purchasers, are entitled to receive one hardcopy edition of the Survey, each year, and online access to the Survey until the next edition of the Survey gets published.

The hardcopy edition of the Survey will only be dispatched upon full receipt of payment.

Subscription Terms and Conditions
As an annual subscriber to the NSS, you authorise AIM to invoice you each year, without requiring you to place an order for the Salary Survey.

In order to receive the member/contributor discounts, we require you to take responsibility for maintain your member/contributor status.

The subscription fee is adjusted in January each year to reflect, amongst other factors, increases in the cost of producing and delivering the survey, increased position coverage and CPI adjustments.

Notification of any intention to cancel your subscription must be received in advance — on or before the last working day in November of the previous year.

In order to ensure that the hardcopy of the Survey is dispatched to the correct address and contact name, we require you to take responsibility for updating us with any changes within your organisation.

A hardcopy invoice will be sent to you, in February, each year, to the address you provide in this form.

Username and Password
Once you purchase the NSS, you will receive associated unique usernames and a password. You may take up additional usernames and passwords for other employees which will be “registered” to your account. Access to the Survey is not to be provided to employees of subsidiary organisations.

You are entirely responsible for all activities which occur under your username and password, or other usernames and passwords registered to your one-off purchase / subscription, even if such activity was unauthorised or undertaken without your consent.

You agree not to share or disclose your username and password or any username and password registered to your one-off purchase/subscription to any person or organisation without the express permission of AIM. Each username and password may only be disclosed to a single person for his or her individual use.

You agree to notify AIM immediately if you become aware of any unauthorised use of your username and password or any username and password registered to your account.

Accuracy of information and disclaimer of warranties

All material published in NSS or supplied to you by AIM is provided in good faith. It is derived from sources believed to be accurate and current as at the date of publication. Your use of NSS or information supplied by AIM is at your sole risk.

Access to NSS is provided on an 'as available' basis. Neither AIM, its related bodies corporate nor its or their directors or employees make any representation or warranty that (i) any material published in NSS will be reliable, accurate or complete (nor do they accept any responsibility arising in any way for errors in, or omissions from that material); or (ii) your access to the NSS website or delivery of its emails will be uninterrupted, timely or secure.

AIM will not be liable for loss resulting from any action or decision by you in reliance on the information published in NSS, nor any interruption, delay in operation or transmission, virus, communications failure, Internet access difficulties, or malfunction in equipment or software.

The material published in NSS or supplied to you by AIM provides general information only. It is not intended as advice and must not be relied upon as such. You should make your own inquiries and take independent advice tailored to your specific circumstances prior to making any decisions.

Being a Contributor
In order to receive the Contributor rate of the National Salary Survey, it is your responsibility to complete your contribution to the National Salary Survey each year.

If you pre-purchase the National Salary Survey as a Contributor, you will need to complete your contribution by the first week of March (for exact dates please call/email).
If you purchase the National Salary Survey after the pre-purchase period, you will need to complete your contribution within 6 weeks of purchasing the survey.

If you do not complete your contribution within the correct time frames, you will be invoiced for the difference between the Contributor and Non Contributor rates.

As a contributor to the Large Company Survey, you must provide a minimum of 25 salary positions in the Salary Section and complete all sections (the Wages and Directors sections are optional).

As a Contributor to the Small Company Survey, you must provide a minimum of 10 salary positions in the Salary Section and complete all sections (the Wages and Directors sections are optional).

The material published in NSS is copyright protected. You may use this material for your own personal reference only. Except for the temporary copy held in the computer's cache and a single permanent copy for your personal reference, the material may not otherwise be used, copied, reproduced, published, stored in a retrieval system, altered or transmitted in any form or by any means in whole or part (except where such use constitutes fair dealing under the Copyright Act) without the prior written approval of AIM.

5.1 You may not use any part of the published material of NSS to establish, maintain or provide, or assist in establishing, maintaining or providing your own publications, Internet site or other means of distribution.

The NSS logo and masthead and AIM logo are copyright. Other logos or trade mark images may be published in NSS material from time to time. These may belong to third parties. Nothing displayed on NSS should be construed as granting any licence or right of use of any logo, masthead or trade mark displayed on the NSS website or emails, without the express written permission of the relevant owner.

Your conduct
As a condition of your one-off purchase/subscription to NSS, you warrant to AIM that you will not use NSS for any purpose that is unlawful or prohibited by these terms & conditions

AIM has no obligation to monitor any user's use of the NSS website, however AIM retains the right at all times to monitor, retain and disclose any information at its discretion or where necessary to satisfy any applicable law, regulation, legal process or governmental request.

You will indemnify AIM, its related bodies corporate and its directors if you suffer any loss or damage or incur any costs in connection with any breach of these conditions or any other legal obligation by you or your use of NSS published material or information supplied by AIM.

Third party links and advertising
Hyperlinks and pointers to websites operated by third parties may appear from time to time on NSS’s website or emails. AIM will accept no responsibility for the contents of any such hyperlink or linked website. If you link to any such website, you agree to do so entirely at your own risk.

NSS material may from time to time display third party advertisements, which may or may not contain hyperlinks or referral buttons to websites operated by third parties. The display of such advertising does not in any way imply a recommendation or endorsement by AIM of the relevant advertiser, its products or services or any such linked website.

If you contact a third party using a hyperlink from NSS material, AIM accepts no responsibility for any actions taken by that third party in response to your communication or for any transactions entered into between you and the relevant third party.

Limitation of liability
AIM does not exclude any rights and remedies available to you under the Trade Practices Act (Cth) or any similar State or Territory legislation which cannot be excluded, restricted or modified. Otherwise AIM and its related bodies corporate exclude all conditions and warranties which may be implied by law, custom or statute.

To the fullest extent permitted by law, AIM’s liability for breach of any implied warranty or condition which cannot be excluded is limited at the option of AIM to the following:

  • in the case of services supplied or offered by AIM,
    (i) the supply of the services again, or
    (ii) the payment of the cost of having services supplied again; and
  • in the case of goods supplied or offered by AIM,
    (iii) the replacement of the goods or the supply of equivalent goods,
    (iv) the repair of such goods or (v) the payment of the cost of replacing the goods or acquiring equivalent goods.

Under no circumstances (including but not limited to any act or omission on the part of AIM) will AIM or its related bodies corporate or its directors be liable for any indirect, incidental, special and/or consequential damages or loss of profits whatsoever which result from any use or access of, or any inability to use or access NSS’s published material or any material supplied by AIM.

Applicable law
These conditions and all other specific and additional terms which govern your use or membership of and access to NSS’s material will be governed by and construed in accordance with the laws of the state of New South Wales, Australia.
