AIM Gold Card Terms and Conditions
1. Introduction
1.1 These Terms and Conditions govern the AIM Gold Card program and the use of the Gold Card and set out important information for Gold Card Holders.
1.2 Each Gold Card Holder is responsible for complying with, and ensuring that any guests comply with, these Terms and Conditions.
1.3 These Terms and Conditions are effective from the date of publication shown
2. Definitions
2.1 In these Terms and Conditions, unless the context otherwise requires:
‘Vocational Qualification’ means the following AIM courses: Advanced Diploma in Digital Marketing, Diploma of Digital Marketing, Diploma of Social Media Marketing, Certificate IV in Human Resource Management, Certificate IV in Project Management Practice, Certificate IV in Leadership and Management, Diploma of Business, Diploma of Business (Leadership), Diploma of Business (Operations), Diploma of Human Resource Management, Diploma of Project Management, Diploma of Leadership and Management, Advanced Diploma of Leadership and Management, Double Diploma: Diploma of Leadership and Management and Diploma of Business, Double Diploma: Diploma of Leadership and Management and Diploma of Project Management, Certificate IV in Work Health and Safety, and Certificate IV in Training and Assessment;
‘AIM’ (also referred to as ‘us’) means Australian Institute of Management Education and Training Pty Limited (ACN 009 668 553);
‘AIM Short Courses’ means AIM unaccredited short courses offered by AIM as set out in the eligible AIM Short Course list;
‘Gold Card’ means the Gold Card issued to a Gold Card Holder;
‘Gold Card Holder’ (also referred to as 'you' or 'your') means a person whom is a participant in a Vocational Qualification Program and holds a Gold Card at the relevant time;
3. AIM Gold Card Program
3.1 The AIM Gold Card Program is available to all AIM Vocational Qualification students who fulfil the following criteria:
(a)an AIM Vocational Qualification student who is fully accepted into the course and currently studying; or
(b)an AIM Vocational Qualification student who has completed the course within two (2) years of beginning their study.
3.2 The AIM Gold Card Program is not available to AIM Vocational Qualification students who are part of a non-public, closed cohort AIM Vocational Qualification program; enrolled through AIM WA; or any students residing outside of Australia.
4. Gold Card Rules
4.1 Your Gold Card will be sent to you electronically via email at the time of course acceptance and activated when payment for the relevant AIM Vocational Qualification is received.
4.2 It may take up to ten (10) to fourteen (14) business days for your Gold Card to be issued and timeframes may be increased over a public holiday period.
4.3 You acknowledge and agree that the Gold Card is not redeemable for cash, not transferable and cannot be used in conjunction with any other offer or vouchers.
5. AIM Short Courses
5.1 Gold Card Holders will need to enrol in available AIM Short Courses via the personalised link found in the email containing your Gold Card.
5.2 Gold Card Holders will have designated spots available in each AIM Short Course and is subject to course availability.
5.3 Courses delivered in partnership with other providers may not be included in the Gold Card Program.
6. Personal Information
6.1 It is a condition of the Vocational Qualification Program that you consent and authorise AIM to collect and use the information on your application form and other information you provide for the purpose of:
(a) AIM or any of its related bodies improving AIM customer service, including by means of research, marketing, product development and planning;
(b) AIM or any of its related bodies marketing its products or services or the products or services of third parties; and
(c) any third-party providing services to AIM, any of its related bodies or Gold Card Holders in connection with the administration of the Vocational Qualification Program.
This information may be transferred to or from Australia for these purposes. If all or any part of requested information is not provided by the Member, the relevant services may be affected.
6.2 AIM will not otherwise disclose your personal information without your consent unless disclosure is either necessary to prevent a threat to life or health, authorised or required by law, reasonably necessary to enforce the law or necessary to investigate a suspected unlawful activity.
6.3 AIM will provide you with access to and the ability to correct your personal information held by AIM on request by you. Further information is contained in our Privacy of Student Information and Records.
7. Changes to AIM Gold Card Program Terms and Conditions
7.1 AIM reserves the right to vary the AIM Gold Card Program to which the Gold Card provides access, and these Terms and Conditions including but not limited to amending which AIM Short Courses are deemed eligible short courses to be included in on the eligible AIM Short Course list.
7.2 AIM will use reasonable endeavours to advise Gold Card Holders of any material changes to the AIM Gold Card Program including but not limited to by publishing the changes in the AIM Learning Management System (myAIM).
7.3 AIM will give notice of any material changes to these Terms and Conditions that will apply to a Gold Card Holder’s then current access period by publishing the changes on the myAIM platform or on its website aim.com.au.
8. Liability
8.1 Some of the goods or services which are offered or provided to Gold Card Holders in addition to the benefits offered as part of the AIM Gold Card Program provided by AIM may be supplied by third party suppliers. The provision of those goods or services will be subject, in each case, to the
terms and conditions of the suppliers and any claims relating to the supply of those goods or services should be made to the supplier.
8.2 AIM will not be liable for refusal by any third party to accept or honour the Gold Card nor will AIM be liable for any loss or damage suffered in relation to the supply of goods or services by third parties.
8.3 Nothing in these Terms and Conditions operates to limit or exclude liability that cannot by law be limited or excluded. AIM acknowledges that the Gold Card Holder may be a consumer for the purposes of applicable State or Federal law in Australia, with the consequence that certain guarantees may be conferred on the Gold Card Holder and certain rights and remedies conferred on the Gold Card Holder, which cannot be excluded, restricted or modified. To the maximum extent permitted by law, AIM’s liability to the Gold Card Holder in respect of a breach of a guarantee or a warranty under these Terms and Conditions is limited to the resupply of the relevant benefit or benefits of the Vocational Qualification Program.
9. Termination
9.1 AIM reserves the right to terminate or cease to operate the AIM Gold Card Program at any time.
9.2 AIM reserves the right in its absolute discretion to terminate the use of any Gold Card at any time by giving such notice to the Gold Card Holder as soon as is reasonably practicable.
Gold card termination includes,
- Not actively progressing in their qualification.
- Does not give necessary notice of enrolment cancellation of short courses.
- Not complying to AIM’s policies and procedures
- None adherence to the Gold Card terms and conditions
9.3 AIM reserves the right to terminate the Gold Card if the holder withdraws from their AIM Vocational Qualification course or fails to make payment in the required timeframes.
